The Trump administration asked the Supreme Court on Wednesday to take a decision on whether President Donald Trump had the authority to impose a comprehensive tariff under the Federal Emergency Law.

This appeal is the result of the Federal Court of Appeal 7-4 that the vast majority of Trump’s tariff was illegal in accordance with the 1977 International Economic Forces Law, although it allowed duties to stay until the case was resolved.

Many states and small companies have defied Trump’s tariff in a lawsuit that it says causes serious economic damage.

“These illegal definitions cause serious harm to small companies and endanger their survival,” said Jeffrey Shawab, a lawyer at the Freedom Center.

However, the Trump administration faced the appeal, on the pretext that hitting tariffs may cause serious economic harm.

The Trump administration said in its resumption: “This decision takes a view of uncertainty about continuous foreign negotiations that the president follows him through the definitions during the past five months, as each of the frames that have already been negotiated and continuous negotiations are presented.” “The risks in this case cannot be higher.”

The officials also indicated that the fees raised 159 billion dollars since late August, a number more than twice the previous year.

Although the constitution gives Congress the authority to put definitions over the years, many legislators delegated those powers to the White House. Although Trump was seen using this in his favor, some of his duties on steel, aluminum, cars and previous definitions in China were left in place by President Joe Biden and not part of this issue.

Legal experts noted that the government also warned that if the courts cancel this tariff, the American treasury may have to recover the billions that were already collected.

The Supreme Court is expected to decide soon if they will take the case directly, which may issue a major judgment on the borders of the presidential authority over trade.
