NEW YORK: Letitia James’ accusation sparks sharp partisan divide
Turley noted that by moving forward, James may claim to be the target of “retaliatory prosecution” and “selective prosecution.” He said Trump’s social media posts urging the Justice Department to take action would likely be key evidence in their defense.
Turley also indicated that he believes the odds will be in James’ favor. He said her legal team would likely challenge the appointment of the acting US attorney who signed off on the charges.
“James will likely argue that the acting U.S. Attorney who signed off on these charges was not properly appointed and therefore should not have held that position,” Turley explained.
“If so, the indictment will be dismissed.”
James and her supporters have portrayed these accusations as politically motivated.

Turley wondered why similar outrage was not expressed during James’ impeachment of Trump.
“I don’t remember Mamdani coming out and denouncing James when she ran for president, vowing to convince Donald Trump of something, without even specifying what it might be,” he said.
“None of these people were objecting to any of that legal warfare.”
