Although not entering the workplace, an employee in Abu Dhabi won a case against a company that failed to honor the employment contract. The company’s local court ordered the payment of 110,400 dirhams (about 26 dollars for an unpaid) with unpaid wages for a job that the employee has never been allowed to start.
The employee, whose name has not been named, signed a fixed contract for the period, which included a basic salary of 7,200 dirhams and a total compensation package of 24,000 dirhams per month, according to the Gulf Times newspaper. The contract was valid from November 11, 2024 to April 7, 2025. But despite the rhetoric of the good offer and all procedures, the company never allowed it to start work.
The employee took the order to the labor court in Abu Dhabi, which ruled in his favor, stressing that the employment agreements are legally binding, even if the employee does not officially bear the responsibility.
“It was clear from the wage report, the employment contract, and the supportive documents submitted through the case management system that the delay in the start of the work was due to the employer,” said Email Al Youm to the court as saying.
The employer claimed that the employee was on vacation and was not reported. However, the court did not find any evidence of any official or evidence of this absence. The employee admitted to take an eight -day vacation, which was presented from the total claim, which led to the salary award for four months and 18 days.
The court summoned Article 912 of the Civil Transactions Law, confirming that wages are the right of the basic factor and cannot be withheld unless there is a evidence written on the formal assignment or legal justification.
