India American Trade – India is still one of the most challenging major economies in the world to protect and enforce intellectual property.

In his recent report, India’s commercial representative (USTR) put India on the “Priority Monitoring List” for the year 2025, describing India as one of the most challenging major economies when it comes to protection and enforcement of intellectual property (IP). “There are still many long -term IP concerns,” said USTR, which issued its Special Report 2025 301 on the adequacy and effectiveness of protecting and enforcing IP rights for trading partners in the United States, despite India’s efforts and increasing participation with the United States.

“India is still one of the most major economies in the world regarding the protection and enforcement of IP. Patent issues are still a special concern in India. Among the other concerns, the potential threat to patent patents and procedural and reports of patent standards under Indian Patent Law companies across various sectors.”

The patent applicants face long waiting periods and excessive reporting requirements. He added that the stakeholders expressed their fears of ambiguity in the interpretation of the Indian patent law.

Ustr says that India justifies the reduction of IP protection to promote access to technologies, but maintains high customs duties on intensive products in IP such as IT and communications technology products, solar energy equipment, medical devices and pharmaceutical preparations. Fears regarding the effectiveness of the India system for protection from unfair commercial use and unauthorized disclosure of pharmaceutical and agricultural chemical products data.

The United States monitors restrictions on the subject of patents in Article 3 (D) of the Indian Patent Law and its effects.

The report added that although India has taken steps to improve the operations of the IP office, the total IP app is still not enough. Action has been taken against pirated content, but its weak enforcement by law enforcement, lack of familiarity with IP investigation technologies, and the absence of coordination between agencies.

Encouraging the creation of more crime enforcement units for the state and an enforcement workshop at the national level of IP crimes, USTR stated that the brand forgery is still a problem, as American brand owners have reported delay in the procedures for opposing brands and concerns related to the quality of the exam.

Ustr said that the Ministry of Promotion for Industry and Internal Trade (DPIIT) has reduced the times of the trademark request, but the concerns remain, as USTR said, and India to join the Singapore Treaty in the Trademark Law.

Ustr also admitted the progress of India in promoting and enforcing IP protection, and dealing with issues related to opposition procedures before it involves patents and reports requirements through patent bases (modification), 2024. The United States will monitor the implementation of adjustments, encouraging additional reforms to reduce patent width times, and improve the patent system in general.
