Washington (AP)-an unknown federal courtA giant monkey key gaveIn an essential part of President Donald Trump’s economic agenda by hitting most of the comprehensive definitions he imposed since he took office.
The International Commercial Court, based in New York, said late on Wednesday that Trump has exceeded his authority using the 1977 law and the International Economic Emergency Forces Law, to justify the customs tariff for Canada, Mexico, China and more than 50 other countries.
So what is the International Trade Court? How can this power be practiced?
Cit is a specialized federal court that usually looks at disputes about customs duties and commercial restrictions. It has evolved from an entity 1890 called the Council of General Victors, and was renamed the customs court in 1926.
CIT usually take high -tech cases that are rarely high -level such as this condition. It deals with trade disputes from all over the country.
Nine judges sit in court, and most of its cases are dealt with by one of these judges. But three judges looked at the challenge facing the Trump tariff, which usually happens when the case includes “the constitutionality of Congress, a presidential declaration or an executive order, or has extensive and important effects,” the court says this.Website.
The three judges in this case were Gary Katzmann, who was appointed by President Barack Obama; Timothy Reef, whom Trump appointed; Jin Rasty, who was appointed by President Ronald Reagan.
Its decisions can be appealed to the Court of Appeal of the Federal Department and then to the Supreme Court. The Trump administration said it would resume, and the Court of Appeal said on Thursday that the duties may remain in view of the case.
Caroline Levit, the White House press secretary, criticized the decision sharply, saying that the members of the Three Judges Committee “offended their judicial power to calm President Trump’s authority” and added that the courts “should not have a role here.”
Levitte said the president’s identification policies are “legally sound and are largely based.”
However, many commercial and legal experts said that at least parts of CIT rule are likely to stand under scrutiny.
Edward Alden, an older colleague in the Council of Foreign Relations, said that the decision that attracts the decrease in the global definitions of Trump by 10 %, as well as the so -called mutual definitions on more than 50 countries, may resist the appeal. This is because, as CIT explained, these duties aim to face the trade deficit in the United States with those countries.
However, Congress specifically said that the duties of dealing with commercial imbalances should be applied under a different law, not iEPA. This law allows a tariff of 15 % with a maximum of up to 150 days.
“I think it is tightly that there is a way to overcome logic, and it controls the Congress definitions and Congress, the authority has explicitly delegated power” to a separate law.
Trump said that his duties in Canada, Mexico and some definitions of China were in response to the alleged shortcomings of those countries in combating illegal drugs and unauthorized immigration. Aldeen said that other judges will find that the president has the authority to impose this customs tariff under the IEPA law.
Other analysts said part of the judgment is likely to be supported as well.
“The court said what everyone knew-that there is no reasonable basis to say that these definitions are linked to fentanel,” said Barry Appleon, a law professor and co-director of the Law Center at the Faculty of Law in New York.
More generally, “under the guise of emergency powers, the president cannot claim what the constitution offers to Congress.”
Some Trump duties – those on steel, aluminum and cars – will remain in place because they depend on separate laws that have not been stabbed. Many economists said that Trump can seek to re -display many of his customs tariffs under a set of other laws that allow definitions, although usually after a legal process can take a few months.
