American organizers say that the Indian authorities did not serve official summons to Gotam Adwani

A legal issue in the Eastern Province in New York, which includes Indian billionaire Gotam Adwani, is facing continuous delays with the US Securities and Stock Exchange Committee (SEC), which informs a federal court that the Indian authorities have not yet made official calls for Aden and his partners.

The latest SEC report, which was submitted on August 11, referred to the procedural challenges in the summons service, which must follow the Hague Service Agreement. The civil lawsuit, which was submitted last year, accused Gotam Adwani, his nephew Sajar Adani, and other violations of the Securities Law and misleading data related to the activities of the Adwani Group.

The charges claimed that a plan to pay about $ 265 million of bribes to Indian government officials to secure solar energy contracts. Prosecutors say this was hidden from American investors. Adani has denied these claims, describing them baseless.

The case report showed that although SEC has actively tried to move the lawsuit forward, progress has stopped due to procedural cases involving legal cooperation across the border. In July, the Supreme Education Council told the court that nearly four months after seeking assistance from the Indian Ministry of Law and Justice, the summons was not held.

According to what was reported, the Ministry of Law sent a request to a court in Ahmed Abad, Gujarat, but the Supreme Education Council did not receive confirmation that the summons was issued. SEC continues to communicate with the Ministry of Indian Law and follow the service under the Hague Agreement. However, as of August 11, the Indian authorities have not completed the service despite the ongoing correspondence.

SEC also sent the case notifications and requests to waive the call service directly to the legal advisor to Adani in India as an additional measure. The legal process follows an indictment that is not designed in New York on November 22, 2024, where Adani and others are charged with bribery and fraud.

The indictment describes the bribery scheme from 2020 to 2024 to obtain solar energy contracts from Indian electricity distribution companies. The United States claims its jurisdiction, as the Adani group has misled American banks and investors while collecting billions for the solar energy project. The civil lawsuit of SEC is separate from the criminal claim, but it is based on the same allegations.
