“Robinhood’s smoke and mirrors arguments fail on inspection, as two federal district courts recently ruled,” the filing states, As reported by sports betting attorney David Wallach.
Robinhood is not an isolated case
the Crypto.com’s latest decision It was noted in support of the state’s argument that the company was barred from continuing to operate sports betting in Nevada. This is part of a much broader push to regulate sports event contracts that seek to emulate sports betting.
While Calci has been working with regulatory bodies to launch sports-related services, the precedent does not necessarily extend to all similar companies, as evidenced by Crypto.com and now likely again by Robinhood. The Massachusetts bodies argue that there is a recurring legal reinforcement “going back decades” that states have the right and responsibility to determine what forms of gambling are permissible.
“Robinhood argues that these laws were implicitly repealed when Congress, under its narrative, expanded the CEA to include swaps in 2010,” the filing states. “But this court is not about striking down a federal law, let alone multiple federal laws.”
With Massachusetts preparing to Waging a similar legal battle against KalshiThis motion against Robinhood provides an example of the types of arguments the state is preparing to launch to protect against what it sees as unlicensed sports betting.
